Ceux qui se pr\u00e9parent \u00e0 temps peuvent minimiser les risques et renforcer leur s\u00e9curit\u00e9 juridique. Nous vous proposons un aper\u00e7u pratique de ces changements.<\/p>\n<p>&nbsp;<\/p>\n<h3><span style=\"text-decoration: underline;\"><strong>1. Allongement du d\u00e9lai en cas de rechute<\/strong><\/span><\/h3>\n<p>L&#8217;une des principales nouveaut\u00e9s concerne la rechute en cas d&#8217;incapacit\u00e9 de travail. \u00c0 partir de 2026, le <strong>d\u00e9lai dit de rechute<\/strong> (<em>rechute<\/em>) est sensiblement allong\u00e9 : une rechute ne donne \u00e0 nouveau droit au salaire garanti <strong>qu&#8217;apr\u00e8s 8 semaines <\/strong>de reprise effective du travail, et non plus apr\u00e8s 14 jours comme auparavant.<\/p>\n<p>Il y a rechute lorsqu&#8217;un travailleur, apr\u00e8s une incapacit\u00e9 de travail pour cause de maladie (ouvrant le droit au salaire garanti), a effectivement repris le travail et retombe ensuite en incapacit\u00e9 de travail pour le m\u00eame motif m\u00e9dical.<\/p>\n<p>La cons\u00e9quence est particuli\u00e8rement importante pour les employeurs : aucun nouveau droit au salaire garanti n&#8217;est ouvert, \u00e0 l&#8217;exception \u00e9ventuelle d&#8217;un solde de salaire garanti encore d\u00fb.<\/p>\n<p>Le salaire garanti est toutefois \u00e0 nouveau d\u00fb lorsque la rechute survient plus de 8 semaines apr\u00e8s la reprise du travail ou lorsque le certificat m\u00e9dical confirme express\u00e9ment que la nouvelle incapacit\u00e9 de travail est due \u00e0 une autre maladie ou \u00e0 un autre accident.<\/p>\n<p>Cette mesure concerne toutes les absences pour incapacit\u00e9 de travail pour cause de maladie qui d\u00e9butent apr\u00e8s le 1er janvier 2026.<\/p>\n<p>&nbsp;<\/p>\n<h3><span style=\"text-decoration: underline;\"><strong>2. Moins de jours sans certificat m\u00e9dical<\/strong><\/span><\/h3>\n<p>La possibilit\u00e9 de s&#8217;absenter le premier jour de maladie sans certificat m\u00e9dical est limit\u00e9e.<\/p>\n<p>\u00c0 partir de 2026, les travailleurs ne pourront plus recourir \u00e0 cette possibilit\u00e9 <strong>que<\/strong> <strong>deux fois par an<\/strong> (au lieu de trois fois auparavant), pour autant qu&#8217;aucune r\u00e8gle d\u00e9rogatoire ne soit pr\u00e9vue au sein de l&#8217;entreprise.<\/p>\n<p>&nbsp;<\/p>\n<h3><span style=\"text-decoration: underline;\"><strong>3. La mise en place d&#8217;une politique active en mati\u00e8re d&#8217;absences devient obligatoire<\/strong><\/span><\/h3>\n<p>\u00c0 l&#8217;avenir, le r\u00e8glement de travail devra r\u00e9gler explicitement <strong>la mani\u00e8re et le moment<\/strong> de maintenir le contact avec les travailleurs en incapacit\u00e9 de travail.<\/p>\n<p>La simple \u00ab bonne pratique \u00bb devient ainsi une <strong>obligation l\u00e9gale<\/strong>. Examinez d\u00e8s \u00e0 pr\u00e9sent votre r\u00e8glement de travail existant. Cette nouvelle exigence vient compl\u00e9ter la liste des mentions obligatoires, ce qui rend une adaptation indispensable.<\/p>\n<p>&nbsp;<\/p>\n<h3><span style=\"text-decoration: underline;\"><strong>4. La force majeure m\u00e9dicale possible plus t\u00f4t<\/strong><\/span><\/h3>\n<p>La proc\u00e9dure visant \u00e0 mettre fin \u00e0 un contrat de travail pour cause de force majeure m\u00e9dicale pourra d\u00e9sormais \u00eatre entam\u00e9e<strong> apr\u00e8s<\/strong> <strong>6 mois d&#8217;incapacit\u00e9 de travail ininterrompue<\/strong> (au lieu de 9 mois auparavant).<\/p>\n<p>Les autres conditions restent inchang\u00e9es, mais cette mesure offre une marge de man\u0153uvre plus rapide.<\/p>\n<p>&nbsp;<\/p>\n<h3><span style=\"text-decoration: underline;\"><strong>5.
