Le l\u00e9gislateur luxembourgeois a r\u00e9agi d\u00e8s 2023 en introduisant le <strong>droit \u00e0 la d\u00e9connexion<\/strong>.<\/p>\n<p>Ce qui \u00e9tait jusqu&#8217;\u00e0 pr\u00e9sent souvent consid\u00e9r\u00e9 comme une \u00ab good practice \u00bb devient d\u00e9sormais contraignant : <strong>\u00e0 partir du 1er juillet 2026, le respect de ce droit sera contr\u00f4l\u00e9 et sanctionn\u00e9<\/strong>. Les entreprises sont donc confront\u00e9es \u00e0 une pression concr\u00e8te d&#8217;agir.<\/p>\n<p>&nbsp;<\/p>\n<h3><strong>1. Un cadre l\u00e9gal avec des exigences concr\u00e8tes<\/strong><\/h3>\n<p>Les employeurs sont tenus de garantir que les salari\u00e9s ne doivent <u>pas \u00eatre joignables en dehors de leur temps de travail<\/u> \u2013 ni par e-mail, ni par t\u00e9l\u00e9phone, ni via des outils num\u00e9riques, sauf en cas d&#8217;exceptions d\u00fbment justifi\u00e9es.<\/p>\n<p>La loi exige express\u00e9ment plus qu&#8217;une simple d\u00e9claration d&#8217;intention. Les entreprises doivent mettre en place<u>, au plus tard le 30 juin 2026, des mesures concr\u00e8tes et des r\u00e8gles internes<\/u> garantissant le respect de la d\u00e9connexion.<\/p>\n<p>La mise en \u0153uvre se fait selon la structure de l&#8217;entreprise :<\/p>\n<ul>\n<li>par des conventions collectives,<\/li>\n<li>via la d\u00e9l\u00e9gation du personnel, ou<\/li>\n<li>par des r\u00e8glements internes.<\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<h3><strong>2. Qu&#8217;est-ce qui change concr\u00e8tement \u00e0 partir de 2026 ?<\/strong><\/h3>\n<p>\u00c0 partir du 1er juillet 2026, le respect du droit \u00e0 la d\u00e9connexion sera <u>contr\u00f4l\u00e9 et sanctionn\u00e9 par l&#8217;Inspection du Travail et des Mines (ITM).<\/u><\/p>\n<p>Les entreprises qui n&#8217;auront pas mis en place de mesures claires et efficaces d&#8217;ici cette date s&#8217;exposent \u00e0 des <u>amendes comprises entre 251 \u20ac et 25.000 \u20ac.<\/u><\/p>\n<p>Le droit \u00e0 la d\u00e9connexion passe ainsi d&#8217;une obligation \u00ab souple \u00bb \u00e0 un v\u00e9ritable sujet de compliance.<\/p>\n<p>&nbsp;<\/p>\n<h3><strong>3. Contenu d&#8217;une politique de d\u00e9connexion efficace<\/strong><\/h3>\n<p>Un dispositif juridiquement s\u00e9curis\u00e9 doit notamment inclure les \u00e9l\u00e9ments suivants.<\/p>\n<p>Tout d&#8217;abord, une <u>d\u00e9finition claire des plages de joignabilit\u00e9<\/u> est n\u00e9cessaire. Les salari\u00e9s doivent savoir quand ils doivent \u00eatre joignables et quand ils ne le doivent pas.<\/p>\n<p>Par ailleurs, les entreprises doivent <u>encadrer concr\u00e8tement l&#8217;utilisation des outils num\u00e9riques<\/u>. Cela concerne par exemple :<\/p>\n<ul>\n<li>l&#8217;envoi d&#8217;e-mails en dehors des heures de travail,<\/li>\n<li>les messages d&#8217;absence automatiques,<\/li>\n<li>ou des mesures techniques (p. ex. envoi diff\u00e9r\u00e9 des e-mails).<\/li>\n<\/ul>\n<p>Un autre point central est la <u>sensibilisation des managers<\/u>. En pratique, la pression \u00e0 la disponibilit\u00e9 permanente na\u00eet souvent indirectement des attentes de l&#8217;\u00e9quipe ou de la hi\u00e9rarchie. Sans prise de conscience au niveau du management, toute politique restera inefficace.<\/p>\n<p>Enfin, les <u>exceptions<\/u>, notamment dans le cadre d&#8217;astreintes ou de n\u00e9cessit\u00e9s op\u00e9rationnelles urgentes, doivent \u00eatre clairement d\u00e9finies.<\/p>\n<p>La mise en \u0153uvre du droit \u00e0 la d\u00e9connexion constitue moins un enjeu purement juridique qu&#8217;un <u>d\u00e9fi organisationnel et culturel<\/u>.<\/p>\n<p>&nbsp;<\/p>\n<h3><strong>4. Conclusion : agir maintenant plut\u00f4t que r\u00e9agir plus tard<\/strong><\/h3>\n<p>Au plus tard avec l&#8217;introduction des sanctions \u00e0 partir du 1<sup>er<\/sup> juillet 2026, le droit \u00e0 la d\u00e9connexion deviendra un point de contr\u00f4le concret pour l&#8217;ITM.<\/p>\n<p>Les entreprises qui n&#8217;auront pas mis en place de r\u00e8gles claires et efficaces s&#8217;exposent \u00e0 des amendes \u00e9vitables pouvant atteindre 25.000 \u20ac, ainsi qu&#8217;\u00e0 des risques juridiques en droit du travail.<\/p>\n<p>Notre recommandation est donc claire : agir d\u00e8s maintenant \u2013 et ne pas attendre.<\/p>\n<p>Les entreprises qui anticipent pourront non seulement \u00e9viter les sanctions, mais aussi garantir que leurs processus internes soient juridiquement s\u00e9curis\u00e9s, compr\u00e9hensibles et solides en cas de contr\u00f4le.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Avec la digitalisation croissante du monde du travail, les fronti\u00e8res entre vie professionnelle et vie priv\u00e9e deviennent de plus en plus floues.
