Pour que tout se d\u00e9roule dans le respect de la l\u00e9gislation, certaines r\u00e8gles importantes doivent toutefois \u00eatre respect\u00e9es.<\/p>\n<p>&nbsp;<\/p>\n<h3><strong>Qu\u2019est-ce qu\u2019un job \u00e9tudiant ?<\/strong><\/h3>\n<p>Un job \u00e9tudiant est une occupation temporaire exerc\u00e9e par une personne qui poursuit encore ses \u00e9tudes et n\u2019occupe pas d\u2019emploi \u00e0 temps plein. Pour pouvoir travailler comme \u00e9tudiant, il faut \u00eatre \u00e2g\u00e9 d\u2019au moins 16 ans. Un jeune de 15 ans peut \u00e9galement \u00eatre occup\u00e9 s\u2019il a termin\u00e9 les deux premi\u00e8res ann\u00e9es de l\u2019enseignement secondaire. \u00c0 partir du <strong>4 mai 2026<\/strong>, tous les jeunes \u00e2g\u00e9s de 15 ans peuvent toutefois conclure un contrat \u00e9tudiant, mais uniquement pour l\u2019ex\u00e9cution de travaux l\u00e9gers.<\/p>\n<p>&nbsp;<\/p>\n<h3><strong>Les principales conditions l\u00e9gales<\/strong><\/h3>\n<p>Lors de l\u2019occupation d\u2019un \u00e9tudiant, plusieurs r\u00e8gles doivent \u00eatre respect\u00e9es.<\/p>\n<p>&nbsp;<\/p>\n<h3><span style=\"text-decoration: underline;\"><strong>1. Contingent d\u2019heures Student@work<\/strong><\/span><\/h3>\n<p>Les \u00e9tudiants peuvent travailler jusqu&#8217;\u00e0 <strong>650 heures par an<\/strong> sous un r\u00e9gime de cotisations sociales r\u00e9duites. Le nombre d&#8217;heures restantes peut \u00eatre consult\u00e9 sur la plateforme en ligne <a href=\"https:\/\/www.studentatwork.be\/fr\/index.html\">Student@work<\/a> ou via <strong>l&#8217;application Student at work<\/strong> (disponible sur l&#8217;App Store ou le Play Store)<\/p>\n<p>Il est permis de travailler davantage, mais les cotisations sociales sont alors plus \u00e9lev\u00e9es.<\/p>\n<p>&nbsp;<\/p>\n<h3><span style=\"text-decoration: underline;\"><strong>2. Contrat de travail \u00e9tudiant \u00e9crit<\/strong><\/span><\/h3>\n<p>Avant le d\u00e9but du travail, un\u00a0<strong>contrat de travail \u00e9tudiant \u00e9crit<\/strong>\u00a0doit \u00eatre conclu. Le contrat doit contenir :<\/p>\n<ul>\n<li>Le d\u00e9but et la fin de la relation de travail.<\/li>\n<li>La description des t\u00e2ches et les conditions de travail.<\/li>\n<li>Les horaires de travail et la r\u00e9mun\u00e9ration.<\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<h3><span style=\"text-decoration: underline;\"><strong>3. D\u00e9claration Dimona<\/strong><\/span><\/h3>\n<p>Avant le d\u00e9but de l\u2019emploi, l\u2019employeur doit effectuer une\u00a0<a href=\"https:\/\/www.socialsecurity.be\/site_fr\/employer\/applics\/dimona\/index.htm\"><strong>d\u00e9claration Dimona<\/strong><\/a>\u00a0aupr\u00e8s de l\u2019ONSS.<\/p>\n<ul>\n<li>La d\u00e9claration est obligatoire.<\/li>\n<li>Elle doit \u00eatre introduite avant le d\u00e9but de l\u2019occupation.<\/li>\n<li>Elle contient les informations essentielles concernant l\u2019\u00e9tudiant et la dur\u00e9e de l\u2019occupation.<\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<h3><span style=\"text-decoration: underline;\"><strong>4. Salaire et r\u00e9mun\u00e9ration<\/strong><\/span><\/h3>\n<p>Le salaire d\u00e9pend du secteur et des conventions collectives applicables.<\/p>\n<p>Veillez toutefois \u00e0 ce que le\u00a0<strong>salaire minimum l\u00e9gal<\/strong>\u00a0soit toujours respect\u00e9.<\/p>\n<p>&nbsp;<\/p>\n<h3><span style=\"text-decoration: underline;\"><strong>5. Cotisations sociales et fiscalit\u00e9\u00a0<\/strong><\/span><\/h3>\n<p>Les aspects sociaux et fiscaux doivent \u00e9galement \u00eatre pris en compte lors de l\u2019occupation d\u2019un \u00e9tudiant :<\/p>\n<ul>\n<li><strong>Cotisations sociales r\u00e9duites<\/strong> : l\u2019employeur verse une cotisation de solidarit\u00e9 de <strong>5,42 % <\/strong>du salaire brut, tandis que l\u2019\u00e9tudiant ne paie que <strong>2,71%<\/strong> sur ce salaire brut.<\/li>\n<li><strong>Revenus exon\u00e9r\u00e9s d\u2019imp\u00f4ts<\/strong>: les \u00e9tudiants sont en principe soumis \u00e0 l\u2019imp\u00f4t sur les revenus.
